
Can the doctor give the partner information in an emergency?
Only if a corresponding power of attorney has been deposited with the family doctor. Couples in a wild marriage should therefore urgently issue mutual powers of attorney in the event of illness, care and death. Otherwise there will be no information about your partner's state of health. And: if one of them is no longer able to make decisions for themselves, the court will appoint a guardian - in the worst case, a complete stranger.
Do they both automatically have custody of their child?
No, the mother and father of the child must - ideally before the birth - declare to the youth welfare office that they wish to exercise joint custody. Since 2013, it has also been possible for the father to apply for custody alone.
Is there an obligation to pay maintenance in a wild marriage?
Only if there are children involved: Unmarried mothers have a maintenance claim against the father for six weeks before and eight weeks after the birth. After this period, they can demand maintenance payments from the father for a further three years. In this case, it is sufficient to state that the woman is prevented from working due to caring for the child.
Do you need a joint tenancy agreement?
No. If one partner moves in with the other, only the landlord needs to be informed, as a second occupant may result in higher service charges. Big disadvantage: If the couple breaks up, the tenant can simply kick the other person out. Experts therefore recommend concluding a subtenancy agreement. If a married couple moves into a new apartment together and both are included in the rental agreement, only the person who remains in the apartment bears the costs after a separation.
Does the remaining partner inherit in the event of death?
Not automatically. He or she only inherits what was granted to him or her in the will. Couples in a wild marriage should therefore record the property claims in the will in good time and in detail.
Is there partner insurance for unmarried couples?
In the case of liability and legal protection policies, the family tariff also applies to couples without a marriage certificate. This is not the case with family insurance policies from statutory health insurance companies: Unmarried partners who are not able to work are not included.
