Circumventing the rent cap
Since June 1, 2015, the rent may not be more than ten percent above the local comparative rent. Ask the tenants' association for a rent index. This also applies to graduated rents.
Handover protocol
An accurate record of the condition of the apartment will save you a lot of money and hassle. Make a note of the number of keys handed over and the meter readings for water, electricity and gas. Record scratches and defects on the kitchen unit, door frame, bathroom or parquet flooring (with a photo if necessary). The report must be signed by both parties. When you move out, you can prove exactly what you have taken over and what you are responsible for. You do not have to pay for normal signs of wear and tear when you give notice.
Distance payments
Compensation payments are not permitted by law. However, so-called transfer agreements are permitted, in which the new tenant takes over furnishings from the previous tenant. If scrap furniture is handed over at pharmacy prices, this is also prohibited. However, not every demand is invalid. The previous tenant may take up to 50 percent more than the current value. Example fitted kitchen: The current value is 1,000 euros. Then the previous tenant may take 1,500 euros. You can reclaim anything above this amount.
